An arrest warrant has been issued for a Michigan man charged with unlawful possession of controlled drug with intent to distribute (marijuana), cultivation of controlled substance, and possessing a firearm during commission of a felony after being stopped on June 11 by Vian police.
Michael R. Herndon, 42, of Scottville, was charged July 16 in Sequoyah County District Court and received a $32,500 bond. After failing to show up for a July 17 arraignment, a bench warrant was issued for his arrest.
Vian Police officer Lethia McLaughlin said on June 11 she made a traffic stop on Herndon for speeding on Hwy. 82 North and Jo’s Road. The officer said when she glanced in the back seat she noticed a large marijuana plant partially covered up by a shirt.
As McLaughlin was calling in Herndon’s drivers license and registration, she notified Vian Police Chief Mark Harkins and officer Caleb Taylor to come to the location.
Harkins located a Colt M4 AR 15 with a round in the chamber, along with an extra magazine and Herndon was placed under arrest.
A total of 16 marijuana plants were found inside the vehicle, along with two half-smoked marijuana cigarettes and a glass pipe smoking device.
